Please read these Terms of Service ("Terms") carefully before using SimpleDMARC ("the Service") operated by SimpleDMARC ("us", "we", or "our"). By creating an account or using the Service, you agree to be bound by these Terms.
1. Use of the Service
SimpleDMARC provides DMARC monitoring, reporting, and analysis tools. You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to use the Service:
- In any way that violates applicable law or regulation.
- To monitor domains you do not own or have explicit authorization to monitor.
- To attempt to gain unauthorized access to any part of the Service or its infrastructure.
- To transmit any unauthorized advertising, spam, or malicious code.
2. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately at support@aevex.tech of any unauthorized use of your account. We reserve the right to terminate accounts that violate these Terms.
3. Subscriptions and Billing
Certain features of the Service require a paid subscription. Subscriptions are billed in advance on a recurring basis. You authorize us to charge your payment method on file for all fees incurred. You may cancel your subscription at any time through the billing portal; cancellation takes effect at the end of the current billing period. We reserve the right to change pricing with 30 days' notice.
4. Free Trials and Promotional Codes
We may offer free trials or promotional discounts. Trials are limited to one per organization. Promotional codes are single-use unless otherwise stated and cannot be combined with other offers. We reserve the right to modify or discontinue trial and promotional programs at any time.
5. Data and Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of information as described in our Privacy Policy.
6. Intellectual Property
The Service and its original content, features, and functionality are and will remain the exclusive property of SimpleDMARC. You may not copy, modify, distribute, or create derivative works based on the Service without our express written permission.
7. Limitation of Liability
To the fullest extent permitted by law, SimpleDMARC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of the Service, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising out of or relating to the Service shall not exceed the amount you paid us in the twelve months preceding the claim.
8. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.
9. Termination
We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination will survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
10. Governing Law
These Terms are governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in the United States.
11. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of significant changes by email or by displaying a prominent notice on the Service. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
